Abstract The 2,167-mile Appalachian Trail stretches continuously from Georgia to Maine, thanks in part to rights-of-way that grant the hiking trail access through property that might otherwise remain under the control of thousands of individual landowners. Imagine a trail where each landowner had the right to enforce his or her interests on passing hikers---from tolls to usage requirements. Such a trail would not be very popular. The trail itself would cease to exist. The common interest would not be served.
